These Terms of Use (“Terms”) govern your use of salumesa.com (the “Site”), operated by Salu Mesa LLC (“Salu Mesa,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms cover the Site itself. Events you book with us are also governed by our Booking, Deposit & Cancellation Policy and by the specific terms confirmed in writing for your event.
1. Who May Use the Site
You must be at least 18 years old to submit an inquiry or book an event. By submitting an inquiry, you confirm that you are 18 or older and that the information you provide is accurate.
2. Our Content
All content on the Site — including photographs, text, menus, recipes, menu names, essays, the Salu Mesa name and logo, and the design and arrangement of the Site — is owned by Salu Mesa LLC or used with permission, and is protected by copyright, trademark, and other laws.
You may view, share links to, and print pages for your own personal, non-commercial use.
You may not, without our written permission:
- Copy, reproduce, or republish our photographs or written content
- Use our content or photographs in any commercial context, including your own marketing
- Use our name, logo, or menu names in a way that suggests endorsement or affiliation
- Scrape, harvest, or systematically download content from the Site
- Use the Site or its content to train machine learning or artificial intelligence models
3. Content You Submit
When you send us an inquiry, message, or any other content, you keep ownership of it. You give us permission to use it for the purpose you sent it — responding to you and planning your event.
Do not send us anything unlawful, threatening, defamatory, or that infringes someone else’s rights.
4. Inquiries Are Not Bookings
Submitting the inquiry form on the Site does not create a booking or reserve a date. It starts a conversation. An event is confirmed only when we confirm it in writing and any required deposit has been received. Availability, pricing, and menus discussed before that point are not guaranteed.
5. Menus, Pricing, and Availability
Menus change with the season and with what is available. Menus and prices shown on the Site are examples and are subject to change without notice. The menu and price for your event are the ones confirmed in writing for your event.
6. Food, Allergens, and Dietary Needs
Salu Mesa is not an allergen-free kitchen. We prepare food in a shared space where common allergens — including but not limited to peanuts, tree nuts, shellfish, fish, soy, wheat, eggs, dairy, and sesame — are present. Cross-contact is possible and we cannot guarantee that any dish is free of any allergen.
We take allergies seriously and will do our best to accommodate them when you tell us in advance. You are responsible for informing us of all allergies and dietary restrictions for every guest before your event, and for making your own final judgment about whether it is safe for you or your guests to eat.
Consuming raw or undercooked meat, poultry, seafood, shellfish, or eggs may increase your risk of foodborne illness, especially if you have certain medical conditions.
7. Alcohol
Salu Mesa does not hold a liquor license and does not sell, serve, or provide alcohol. All events are bring your own bottle. Any alcohol at an event is provided by the host, who is solely responsible for it, including ensuring that no one under 21 is served. See our Booking, Deposit & Cancellation Policy for full terms.
8. Third-Party Links
The Site links to other websites, including Instagram and TikTok. We do not control those sites and are not responsible for their content, their practices, or their privacy policies. Visiting them is at your own risk.
9. Disclaimer of Warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that the information on it is complete or current.
10. Limitation of Liability
To the fullest extent permitted by law, Salu Mesa LLC and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site, including lost profits or lost data, even if we have been advised of the possibility of such damages.
Our total liability arising out of or relating to your use of the Site will not exceed one hundred dollars ($100).
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence, or for fraud. This section applies to your use of the Site; liability relating to a booked event is addressed in the terms confirmed for that event.
11. Indemnification
You agree to indemnify and hold harmless Salu Mesa LLC from any claims, damages, and reasonable attorneys’ fees arising out of your violation of these Terms or your misuse of the Site.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms at any time. Changes take effect when posted, and we will update the “Last updated” date. Continuing to use the Site after a change means you accept the updated Terms.
14. Severability
If any part of these Terms is found unenforceable, the rest remains in effect.
